Northern Arizona University Event Terms and Conditions
These Event Terms and Conditions, in addition to the Arizona Board of Regents (“ABOR”) for and on behalf of Northern Arizona University (“NAU”) Standard Terms and Conditions, apply to any Supplier providing services for an NAU event (“engagement”).
- Control. NAU expressly reserves the right to control the manner, means, and details of the overall engagement. Supplier shall have creative control over the presentation and performance.
- Sound Levels. If the Supplier’s representative is to operate and control the sound system during the engagement, Supplier agrees that the sound level will be mutually agreed upon between NAU’s representative and Supplier’s representative. If NAU notifies Supplier’s representative that the sound level is inappropriate, Supplier’s representative will adjust the sound level to a mutually agreed upon level. Sound levels for the engagement may not exceed one hundred decibels (100db) at the house mix location. Supplier shall pay two hundred and fifty ($250.00) per occurrence for exceeding 100db. These sums may, at NAU’s option, be deducted from any balance paid to Supplier following the engagement.
- Media. NAU reserves the right to warrant authorization in admitting media personnel to any and all engagements.
- Under the Influence. In the event Supplier arrives at the engagement location noticeably under the influence of or in possession of alcoholic beverages, narcotics, or illegal drugs, Supplier will have violated this Agreement and payment will be forfeited. In the event of such a cancellation the Supplier will be responsible for all engagement related expenses incurred by NAU.
- Recording. NAU agrees not to record for reproduction or transmission the engagement, in the absence of a specific written agreement with the Supplier. NAU further agrees to notify attendees that recording is prohibited, however, NAU is not liable for any recordings or broadcasting made by individual attendees.
- House Rules and Liability. Supplier agrees to abide by any house rules and terms of the facilities at which the engagement occurs and assumes full liability and responsibility for all injuries and/or property damages caused in whole or part by Supplier or invitees.
- Cancellation. In the event of cancellation by Supplier, Supplier shall be made available to make all cancellation announcements to the public, media, and the like. In the event of cancellation by Supplier for any reason other than a force majeure event, Supplier shall reimburse NAU for all documented out-of-pocket expenses.
- Oxygen. Flagstaff is at an elevation of 7,000 feet above sea level. If Supplier will require additional oxygen, arrangements must be made directly between Supplier and an appropriate vendor.
- Warranty. Supplier warrants that at all times during the engagement, Supplier will personally provide Supplier’s best professional efforts.
- Press Materials. Supplier will timely supply all press/promotional materials requested by NAU.
