Dependent Child Arizona Domicile Affidavit 

The Dependent Child Arizona Domicile Affidavit is for students 24 and under who are classified as non-resident but have a parent or legal guardian living in Arizona. This affidavit is acceptable for students who have one parent living in Arizona and one living out of state. Even if the student attended an out of state high school, they may qualify under this affidavit if they meet the rest of the requirements.  

There is no 12-month requirement for this method; the parent and student need only prove that they made Arizona their primary home before the start of the semester. If the student’s parent or legal guardian permanently relocates to Arizona during the student’s academic career the student can petition for residency whether it is their first semester at NAU or their last. 

The student must meet ALL five of these requirements as defined by the Arizona Board of Regents to be considered an Arizona resident for tuition purposes. Those requirements are: 

1. The student lives in Arizona Accordion Closed

  • This affidavit requests the student’s Arizona ID, voter registration and vehicle registration be submitted. If these cannot be submitted explain why in the missing documentation explanation.  

2. The student is under the age of 25. Accordion Closed

  • Students must be 24 or under during the entire calendar year of the semester they are seeking residency. 

3. The student is unmarried Accordion Closed

  • If the student is married, please look into completing the Spouse Affidavit. 

4. The student has at least one parent or court-ordered legal guardian whose primary home is also in Arizona Accordion Closed

  • The domicile of the student’s parent is in Arizona. 
  • “Domicile” or “Domiciled” means an individual’s true, fixed, and permanent home and place of habitation. It is the place where the individual lives, intends to remain, and to which the individual intends to return when leaving without intending to establish a new domicile elsewhere. 
  • Owning property in Arizona does not necessarily qualify someone as an Arizona resident. 

5. The parent or court ordered legal guardian in Arizona is eligible to claim the Student as a Dependent Child on their taxes Accordion Closed

  • The parent of the student domiciled in Arizona is entitled to claim the student as an exemption for federal and state tax purposes (whether the parent claims the student as an exemption).

Definitions and Things to Know: 

  • “Objective Evidence” means documentation or information other than your own statement(s) of intent.  
  • The term “resident for tuition purposes” differs from other definitions of Arizona residency. You can be a resident for other purposes and not be a resident for tuition purposes.  
  • “Parent” means the student’s father or mother (including adoptive parent), or if one parent has custody, that parent, or the legal guardian of an unemancipated individual provided there is no evidence indicating that the guardianship was created primarily for the purpose of conferring the classification of resident on the individual. 
  • “Guardian” means a legal guardian.  
  • To qualify as an Arizona resident for tuition purposes, you must have U.S. Citizenship, a permanent resident card, or an eligible visa to qualify. You can view the visa eligibility here. 
  • The residency office will review all facets of your academic career in our review of your petition – this includes your application for admission, financial aid awards and any communications with the residency office or other NAU offices. We may verify or investigate the authenticity of any documents submitted. 
  • Missing or incomplete documentation can cause your petition to be denied or delayed. If there is something you cannot provide, please explain in the missing documentation explanation section instead.  
  • Additional documentation may be requested by the residency office after our initial review of your petition and supporting documents. Please respond promptly to ensure your review can be completed. 
  • We will communicate with the students via their NAU email address. It is your student’s responsibility to check their email and respond in a timely manner. 
  • Parents, if you are looking for an update regarding an affidavit submission, first ask your student if they have received anything to their NAU email account. We may require your student to have a FERPA release on file before releasing any account information. 
  • The residency office is required to follow Arizona Board of Regents policy, which is state law.
