Qualifying Federal Service Affidavit<\/span>\u00a0<\/span><\/h1>\n

This affidavit is for Qualifying Federal Service Members OR their spouses or dependent children. <\/span>Members of the Armed Forces should complete the <\/span>Armed Forces\/Active Duty\/Guard\/Reserve Affidavit.<\/span><\/a><\/p>\n

Effective July 1, 2024 and forward<\/strong><\/b><\/em><\/p>\n

    \n
  1. A member of the armed forces <\/strong><\/b>who is on active duty for a period of more than 30 days.<\/li>\n
  2. A member of the Foreign Service<\/strong><\/b> is a person who is on active duty for a period of more than 30 days. For more information, please visit https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2009-title22\/pdf\/USCODE-2009-title22-chap52.pdf<\/a><\/b><\/li>\n
  3. An officer or employee of an element of the intelligence community<\/strong><\/b> who serves in a position of employment in such element for a period of more than 30 days.<\/li>\n<\/ol>\n

    Who is Considered a Member of Qualifying Federal Service?<\/p>\n

    22 U.S.C. § 3903<\/strong>
    \nThe following are the members of the Service:
    \n• Chiefs of mission, appointed under section 3942(a)(1) of this title or assigned under section 3982(c) of this title.
    \n• Ambassadors at large, appointed under section 3942(a)(1) of this title.
    \n• Members of the Senior Foreign Service, appointed under section 3942(a)(1) or 3943 of this title, who are the corps of leaders
    \nand experts for the management of the Service and the performance of its functions.
    \n• Foreign Service officers, appointed under section 3942(a)(1) of this title, who have general responsibility for carrying out the
    \nfunctions of the Service.
    \n• Foreign Service personnel, United States citizens appointed under section 3943 of this title, who provide skills and services
    \nrequired for effective performance by the Service.
    \n• Foreign national employees, foreign nationals appointed under section 3943 of this title, who provide clerical, administrative,
    \ntechnical, fiscal, and other support at Foreign Service posts abroad.
    \n• Consular agents, appointed under section 3943 of this title by the Secretary of State, who provide consular and related
    \nservices as authorized by the Secretary of State at specified locations abroad where no Foreign Service posts are situated.<\/p>\n

    \nThe term “intelligence community” includes the following:
    \n• The office of the director of national intelligence
    \n• The Central Intelligence Agency
    \n• The National Security Agency
    \n• The Defense Intelligence Agency
    \n• The National Geospatial Intelligence Agency
    \n• The National Reconnaissance Office
    \n• Other offices within the department of defense for the collection of specialized national intelligence through reconnaissance
    \nprograms
    \n• The intelligence elements of the Army, the Navy, the Air Force, the Marine Corps, the Space Force, the Coast Guard, the FBI,
    \nthe DEA and the Department of Energy
    \n• The Bureau of Intelligence and the Research Department of the State
    \n• The Office of Intelligence and Analysis of the Department of the Treasury
    \n• The Office of Intelligence and Analysis of the Department of Homeland Security
    \n• Such other elements of any department or agency as may be designated by the President, or designated jointly by the Director
    \nor National Intelligence and the Head of the Department or Agency concerned, as an element of the Intelligence Community<\/p>\n
